§1 Scope of Application

These Terms and Conditions apply to all contracts concluded between

(hereinafter referred to as “we” or “SYNLESS”)
and consumers within the meaning of Section 13 of the German Civil Code (BGB)
via our online shop.

Any terms and conditions of the customer that deviate from or supplement these Terms and Conditions shall not apply unless we have expressly agreed to their validity in writing.

§2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an order.

(2) By clicking the button “Buy now”, you submit a binding purchase offer.

(3) The contract is concluded when we accept your order by sending an order confirmation by email or by dispatching the goods.

(4) The contract text is stored. The order details and these Terms and Conditions will be sent to you by email.

§3 Prices and Payment Terms

(1) All prices stated are final prices in euros and include statutory value-added tax, where applicable.

(2) In addition to the stated prices, shipping costs may apply. These will be clearly indicated before the order is completed.

(3) The following payment methods are available:

  • Shopify Payments (credit card)
  • PayPal
  • Klarna
  • Apple Pay
  • Google Pay

(4) Payment processing is carried out via the respective payment service providers. Their terms and conditions apply.

§4 Delivery and Shipping

(1) Delivery is made to the delivery address specified by the customer.

(2) Delivery times stated in the shop are non-binding estimates unless a binding delivery date has been expressly agreed.

(3) The risk of loss or damage to the goods passes to the customer only upon delivery of the goods to the customer.
This also applies in the case of shipment.

(4) Partial deliveries are permissible provided they are reasonable for the customer.

§5 Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

§6 Retention of Title

The goods remain our property until full payment has been made.

§7 Warranty

(1) The statutory warranty rights apply.

(2) Claims for defects are subject to the statutory limitation periods.

(3) Obvious transport damage should be reported to the delivery service provider immediately. Failure to do so does not affect your statutory rights.

§8 Liability

(1) We shall be liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health.

(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), liability shall be limited to the typically foreseeable damage.

(3) Otherwise, liability is excluded to the extent permitted by law.

(4) Liability under the German Product Liability Act remains unaffected.

§9 Product Presentation and Availability

(1) Product images are for illustrative purposes only. Color deviations may occur, in particular due to different screen displays.

(2) We reserve the right to remove products from our range at any time.

(3) If a product is unavailable, we will inform you without delay and refund any payments already made.

§10 Use of the Online Shop

(1) The online shop may only be used for lawful purposes.

(2) In particular, it is prohibited to:

  • use the shop for fraudulent purposes
  • circumvent security mechanisms
  • upload or distribute malicious software

(3) We reserve the right to suspend user accounts in the event of violations.

§11 Intellectual Property

All content of the online shop (texts, images, logos, designs) is protected by copyright.

Any use beyond private purposes requires our prior express consent.

§12 Third Parties and Shopify

(1) Our online shop is operated via the platform Shopify Inc.

(2) Purchase contracts are concluded exclusively between you and SYNLESS.

(3) Shopify is not a contracting party and assumes no liability for contracts concluded via the shop.

§13 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, available at:
privacy policy.

§14 Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

§15 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

§16 Final Provisions

(1) Should individual provisions of these Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

(2) The statutory provisions shall replace the invalid provision.
